2. Client Responsibilities

By using our services, you agree to:

Obtain all necessary consents from your own customers (including for SMS/MMS and email marketing).

Comply with all applicable laws, including HIPAA (if applicable), TCPA, CAN-SPAM, and marketing regulations.

3. SMS/MMS Marketing Compliance

We may send SMS/MMS messages on your behalf to contacts who have opted in. You acknowledge that:

You are responsible for ensuring that your customer list contains only those who have given valid consent.

All campaigns will include opt-out instructions (“Reply STOP to unsubscribe. HELP for help. Msg&Data rates may apply.”).

We reserve the right to refuse or halt campaigns that do not meet compliance requirements.

4. Payment Terms

Payment terms will be outlined in your specific service agreement or invoice. Failure to pay may result in suspension of services. All fees are non-refundable unless otherwise stated in writing.

5. Intellectual Property

All creative materials, designs, copy, and strategies provided remain the property of Lobel Digital Solutions unless otherwise agreed in writing. Upon full payment, certain deliverables may become the property of the client as specified in the agreement.

6. Limitation of Liability

To the fullest extent permitted by law, Lobel Digital Solutions shall not be liable for any indirect, incidental, consequential, or punitive damages, including lost profits or data, arising from your use of our services. Our total liability shall not exceed the total fees paid to us for the specific service giving rise to the claim.

7. No Guarantees

We make no guarantees regarding the number of leads, sales, or revenue generated through our marketing services. Results may vary based on market conditions, client cooperation, and other factors outside our control.

8. Termination

Either party may terminate services with written notice, subject to the terms of any signed agreement. Outstanding payments remain due upon termination.

9. Changes to Terms

We may update these Terms from time to time. The revised Terms will be posted on our website with an updated effective date.

10. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law provisions.
